The 2018 Farm Bill Has Changed the Way CBD Can Be Used

The 2018 Farm Bill has played a major role in the surge of people across the USA choosing to add CBD products into their daily life. Until the Farm Bill was enacted, the use of any cannabis-derived products, including CBD, was illegal at the federal level.

Each state had its own laws and guidelines regarding the sale and use of CBD. State laws varied drastically, from CBD being entirely legal to it being illegal even when used for medical reasons. The very different approaches that states took on the issue caused a great deal of confusion, especially for people traveling out of state who relied on medical CBD products.

The Farm Bill provided some clarity on the legality of CBD products by altering the law at a federal level. Under the Farm Bill, CBD and hemp products that contain less than 0.3% are legal to sell, purchase and use. This meant that for the first time, CBD products were legal at the federal rather than just the state level.

Despite the change in federal law, the legality of flying with CBD products like CBD vape pens has remained unclear for several years.

Recent TSA Guidance About Flying with CBD

By making CBD products legal on a federal level, the 2018 Farm Bill implied that traveling across state lines with CBD was completely legal. Problems remained, however, when it came to flying domestically with CBD products, as the TSA failed for many years to clarify the issue.

It was not until recently that the TSA addressed the issue with an official statement about passing through their security with CBD. Under the new TSA guidance, products that contain no more than 0.3% THC on a dry weight basis, or those approved by the FDA, can legally pass through airport security without raising concern.

Following the new TSA guidance, it is, therefore, legal to take CBD products that meet the THC limits set out under the Farm Bill through security and onto planes. In the case of CBD products like oils, capsules, and edibles, most airlines do not have restrictions preventing them from being used during a flight.

The TSA states that passengers can carry electronic cigarettes and vaping devices with them while traveling in their carry-on bags. The TSA also states that vape pens and electronic cigarettes cannot be packed into checked bags for safety reasons.

Vaping and smoking are illegal in almost every airport around the world, and for safety reasons, airlines also ban smoking and the use of vape pens during flights. This means that while CBD vape pens can be carried in carry-on bags, they cannot be used from the point of entering an airport and should not be used again until leaving the airport at the other end of the journey.
